This Privacy Notice applies to the companies comprising TUBACERO, which hereby inform you of the terms and conditions, based on applicable laws and regulations, regarding the processing of Personal Data collected from individuals and/or legal entities. Therefore, we kindly request that you carefully read the following information:
For the purposes of this Privacy Notice, the companies belonging to the group declare that they are legally constituted under Mexican law and that they will be individually responsible for the personal data they collect. For the aforementioned purposes and obligations, they all designate as their address the property located at: Av. Guerrero No. 3729 Norte, Col. Del Norte, Monterrey, N.L., Mexico.

The data will be obtained solely and exclusively directly, that is, in person or through electronic means made available to you. This data will be collected for the purpose of monitoring hiring processes, fulfilling contracts, agreements, or covenants, or for the purpose of business relationships.
The Data Controller may conduct investigations, interviews, and, in general, take any actions it deems necessary to verify, either directly or through third parties specifically contracted for this purpose, the accuracy of the personal data provided.
The Data Controller may, under this Privacy Notice, verify, add to, or supplement the personal data collected directly from the Data Subject, as well as any personal data of third parties provided by the Data Subject. It is the Data Subject's responsibility to inform third parties about the information or documentation they provided to the Data Controller and the purposes for which it was provided, as well as the content of this Privacy Notice.
PURPOSE OF DATA PROCESSING.
Personal data will be used for the following activities or purposes:
To verify the identity and accuracy of the Data Subject's information, as well as the information they have provided about third parties, as applicable and in accordance with current legal provisions.
To analyze information, risk levels, payment feasibility, the Data Subject's transactional profile, and, in general, to conduct evaluations for granting credit to the Data Subject.
Integrate databases and process them directly or through a third party, so that the Data Controller can provide services or sell products related to its business purpose, or, where applicable, report the illegality of the information to the Authorities when required by applicable laws in force in the Republic of Mexico.

LIMITATION ON THE USE OR DISCLOSURE OF DATA.

PROCESSING OF PERSONAL DATA AND ITS TRANSFER.
In accordance with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties, its regulations, and other applicable legislation, the Data Controller informs you that the Data Subject's consent will not be required for the processing of personal data in the following cases: (i) when provided for by law, (ii) when the personal data is contained in publicly accessible sources, (iii) when the personal data is subject to a de-identification procedure, (iv) when it is for the purpose of fulfilling obligations arising from a legal relationship between the Data Subject and the Data Controller, (v) when there is an emergency situation that could potentially harm an individual or their property, (vi) when the data is essential for medical care, prevention, diagnosis, the provision of healthcare, medical treatments, or the management of healthcare services, while the Data Subject is unable to grant consent, in accordance with the terms established by the respective law and other applicable provisions, or (vii) when a resolution is issued by a competent authority.
By accepting this Privacy Notice, the Data Subject authorizes the Data Controller to transfer personal data between companies within the Group, without the need to obtain their consent again.
The Data Controller is committed to ensuring compliance with the principles of personal data protection established in the Law and its Regulations, and to adopting the necessary measures for their application, as well as requiring compliance from individuals or legal entities to whom personal data may be transferred or access granted, in order to provide you with appropriate service of the highest quality.
MEANS TO EXERCISE ARCO RIGHTS.
The Data Subject has recognized ARCO Rights, which they may exercise with the Data Controller, as granted by the Law and its Regulations.

To exercise any of your ARCO rights, you may submit a request to the email address info@tubacero.com.
The Data Controller will notify you of the response to your request for access, rectification, cancellation, or opposition within a maximum of 20 (twenty) business days from the date the corresponding email is received.
If you wish to revoke the authorization granted to the Data Controller regarding the personal data provided, you must submit the corresponding request under the same terms established in this Privacy Notice or, failing that, as established by the Law and its regulations.
If the Data Subject revokes the authorization granted to the Data Controller for the processing of their personal data, such revocation may result in the suspension of services provided by the Data Controller in order to comply with applicable legal provisions or the Data Controller's internal policies.
COMMUNICATION OF CHANGES TO THE PRIVACY NOTICE.
The Data Controller reserves the right to make changes to this Privacy Notice, which will be communicated directly to Data Subjects or through its website: www.tubacero.com.
